El presente trabajo plantea la necesidad de volver a la clásica distinción de conocimiento teórico y conocimiento práctico y repensar el lugar de la voluntad y la libertad humanas en el proceso cognoscitivo en general. Desde la consideración de la noción de conciencia, del valor dado a la dimensión cognoscitiva en el ámbito moral, la índole del conocer como relación con lo real y la idea de verdad, llegamos a la conclusión de que el planteamiento racionalista que excluye a la (...) fe como ajena al conocimiento lo hace por el mismo motivo por el que excluye a la voluntad: para evitar la necesidad de tener que decidir. El objetivo principal de este trabajo es dar a conocer en lengua castellana un texto del profesor Thomas Buchheim acerca de la «última prueba» de la existencia de Dios a partir del futurum exactum de su maestro, Robert Spaemann. Para ello se analiza en primer lugar el argumento del futurum exactum del «haber-sido». Seguidamente se exponen las objeciones contra el argumento presentado de esta forma. A continuación, la presentación del argumento a partir del futurum exactum de la verdad. Voluntary abortions are relatively frequent and their care is complex due to the social stigma that surrounds these losses. This interpretive meta-ethnography of 11 original qualitative articles aims to synthesize the moral experiences of nurses and midwives who cared for women and couples that decided to abort or terminate the pregnancy due to foetal abnormalities. Lines of argument synthesis emerged after reciprocal and refutational translations, together with the metaphor, ‘Going with the flow or swimming against the tide’. Caring in these (...) situations was an ethical dilemma when a conflict existed between their professional duty and their moral principles. In these instances, care was associated with a significant emotional cost. They did not feel sufficiently prepared or with adequate resources, which favoured avoidance behaviours. However, the feeling of professional duty was stronger than their prejudices, and they became engaged in caring. These results could improve knowledge, clinical practice and education, being a (highly) reasonable representation of the phenomenon of interest. (shrink)

Background Abortion is one of the most common gynaecological procedures. It is related to personal, social, and economic reasons under a legal term that is recognised as a common sexual and reproductive right in most of countries. However, making the decision to abort is complex, because it is politicised and is often framed in public discourse related to moral or ethical issues beyond women’s experiences. Therefore, it is subject to medical criteria, religious evaluations, and sociological analysis. Purpouse The aim of (...) this synthesis of qualitative studies was to synthesise the decision-making experiences of women who legally aborted. Research design and method The Noblit and Hare’s interpretive meta‐ethnography was conducted, and it was written in accordance with the eMERGe meta‐ethnography reporting guidance. Ten studies met the research objective and inclusion criteria, after a comprehensive systematic search strategy in five databases. Findings The metaphor “The wrestling between why and what will happen next” and three themes emerged from the data analysis: (1) Forces that incite the arm wrestling; (2) Facing social stigma; and (3) Defeated by a greater rival. The metaphor provided interpretive experiences of the moral conflict experienced by women who decided to have an abortion and emerged from the confrontation of the reasons why they decided to abort and the social repercussions that making the decision entails. The result of the struggle was loneliness and vulnerability. Conclusion The lines of action impact policy makers, the media, and health professionals. Actions should focus on the de-stigmatisation and normalisation of abortion, the use of appropriate language, and the training and sensitisation of health professionals. (shrink)

Pragmatic competence includes the capacity to express illocutionary force and successfully achieve perlocutionary effects, in order to guarantee fully functional communication exchanges. Alzheimer’s Disease is characterized by a constellation of limitations derived from progressive cognitive impairment, which is usually viewed as a global uniform phenomenon. In this paper it is argued that looking independently at the loss and recovery of pragmatic function related to illocutionary and perlocutionary abilities can be a productive way of understanding the progressive deterioration of communicative capacities (...) by patients or their improvement under targeted treatment. The impact of the AFSJ in the development of an EU standard of fundamental rights, which has come to the fore since the Treaty of Lisbon, is a topic of great theoretical and practical importance. This is the first systematic academic study of the AFSJ and its implications (...) from the point of view of fundamental rights. The contributions to this collection examine the normative and jurisprudential development of the AFSJ in order to assess its effects on the overall construction of the scope and standards of protection of EU fundamental rights in this particularly complex and sensitive field of integration. BackgroundThe COVID-19 pandemic has hit almost all countries around the globe, seriously affecting the welfare of populations. Spain is especially hard-hit. In this context, the purpose of the present study is to analyze social, demographic, and economic correlates of mental health during the COVID-19 pandemic in the population residing in Spain.MethodThe sample of this cross-sectional study was comprised of 801 participants aged 18 or older and residing in Spain. Data collection was carried out during March and April 2020. Data of (...) mental health and well-being indicators, and those of a wide number of social, demographic, and economic variables were recorded. Linear regression models were built to value associations between mental health and social, demographic, and economic indicators.ResultsMental health morbidity was higher in women, younger people, individuals with medium studies, people with fewer children, singles, students, and unemployed individuals. Positive affect was higher among women, people with a high level of studies, those not co-living with dependent seniors, the self-employed, the employed, and those working outside home. Negative affect was negatively associated with age and number of children and was higher among women, people with basic studies, singles, individuals co-living with dependent seniors, homemakers, and students.ConclusionThe most vulnerable populations were found to be women, younger people, people with basic or medium studies, students and individuals with no remunerated activities, single populations, and those co-living with dependent seniors as well as those with a reduced number of children. This paper examines the outcomes of Preserving the Past Together, a workshop series designed to build the capacity of local heritage managers to engage in collaborative and community-based approaches to archaeology and historic preservation. Over the past two decades practitioners of these approaches have demonstrated the interpretive, methodological, and ethical value of integrating Indigenous perspectives and methods into the process and practice of heritage management and archaeology. Despite these benefits, few professional resources exist to support the development of collaborative relationships (...) between local heritage managers and Tribal nations. Filling this need, Preserving the Past Together’s interactive workshops and keynote lectures involved participants in a discussion of the central themes in collaborative and Indigenous approaches to archaeology today, highlighting the local challenges and opportunities that exist for archaeologists, heritage managers, and Tribal nations to work together to care for the past. This paper presents an overview of the event series’ goals, the strategies it used to foster collaboration among the diverse stakeholders of the Salish Sea, and the next steps the project’s co-directors are taking to further support communication and collaboration between stewards and stakeholders in the Pacific Northwest. El trabajo desarrollado en este artículo muestra una experiencia docente basada en la Metodología Activa del Aprendizaje Basado en Proyectos en la asignatura de Instalaciones II de la titulación del Grado en Arquitectura Técnica de la Universidad de Burgos. Para alcanzar la excelencia del proceso de enseñanza y aprendizaje, se ha diseñado una metodología de trabajo basada en el desarrollo progresivo de un Proyecto de Ejecución mediante subproyectos, con el objetivo de conseguir mejores resultados en el proceso de aprendizaje mediante (...) el desempeño personal, la retroalimentación de procesos y el trabajo cooperativo, todo ello orientado a la excelencia académica y profesional de los estudiantes. Los resultados obtenidos muestran que el ABP es una excelente metodología para el proceso de enseñanza-aprendizaje de la asignatura de Instalaciones II y para el futuro desempeño profesional de los estudiantes. El presente artículo tiene el objetivo de determinar los rasgos lingüísticos más relevantes de 160 titulares periodísticos deportivos que emplean el discurso directo o reproducción literal de lo enunciado, enfocándose en sus características sintácticas. Los titulares considerados para esta investigación fueron tomados de cinco diarios deportivos y de otros tres diarios nacionales mexicanos. Todos los titulares examinados hacen uso del discurso directo. A través del presente estudio, pretendemos aportar nuevos datos a una caracterización integral de los titulares, más específicamente en (...) el ámbito del deporte. Para examinar el corpus, tomamos en consideración la clasificación de Escribano, complementada por las elucidaciones de Hurtado González y Nadal Palazón. En nuestro corpus la estructura más frecuente resultó aquella de construcción bimembre que enfrenta la cita directa con el responsable de dicha cita. Enseguida, ubicamos la estructura que presenta la cita + verbum dicendi + responsable de la cita. Los titulares que emplean la cita directa exclusivamente y aquellos que entrecomillan un solo término fueron los menos recurrentes. (shrink)

RESUMEN Cuando se mira la masacre de El Salado, es difícil no preguntarse por los factores que llevaron a esta comunidad de los Montes de María, en el contexto de la guerra rural que vivía Colombia a finales del siglo XX, a volverse un objetivo militar por parte de las A.U.C. (Autodefensas Unidas de Colombia), es decir, a recibir la marca o estigma de 'pueblo guerrillero'; en otras palabras, a convertirse en un pueblo masacrable. El presente artículo intenta abordar esta (...) cuestión y para ello analiza las consecuencias de la ocupación de las FARC desde su ingreso a la región en los noventa. Los modos como este poder fareano dispuso de lógicas guerreristas y dejó poco margen de maniobra y libertad para los pobladores de El Salado; los saladeros no tuvieron opción ni libertad, y la cohabitación se confundió con la colaboración, la pasividad con la pertenencia. En una segunda parte, revisa los efectos de la arremetida brutal de las FARC contra cierto grupo de pobladores (en especial, ganaderos y fuerza pública); de algún modo, la masacre del 2000, ejecutada por las AUC, fue una respuesta impulsada por un odio desmedido frente a una violencia también excesiva por parte de las FARC en los años anteriores a la masacre. En este apartado, se habla acerca del odio y la venganza que se constituyen en afectos que contribuyeron decisivamente -entre otros más- a la masacre del año 2000. Las elaboraciones sobre la economía del odio de Sara Ahmed (2015) y las de Laura Quintana sobre los afectos (2020 y 2021) serán fundamentales. ABSTRACT When looking at the El Salado massacre, we wonder about the factors that led this town of los Montes de María, in the context of the rural war in Colombia at the end of the 20th century, to become a military objective by the A.U.C (Autodefensas Unidas de Colombia), that is, to receive the brand or stigma of 'guerrilla people'; that is, to become a massacrable town. This article tries to address this issue, thus analyzing the consequences of the FARC occupation since its entry into the region in the nineties. Ways like this Farean power had warmer logic and left little room for maneuver and freedom for the residents of El Salado; The saladeros had no choice or freedom, and cohabitation was confused with collaboration, passivity with belonging. in a second part, it reviews the effects of the brutal attack by the FARC against a certain group of residents (especially, ranchers and the military); in a way, the 2000 massacre, carried out by the AUC, was an inordinately hateful response to excessive violence by the FARC in the years before the massacre. In this section, we talk about the hatred and revenge that constitute elements that contributed decisively -among others- to the 2000 massacre. The elaborations on the economy of hate by Sara Ahmed (2015) and the elaborations of Laura Quintana on affects (2020 and 2021) will be fundamental. (shrink)

Mortensen studies dual intuitionistic logic by dualizing topos internal logic, but he did not study a sequent calculus. In this paper I present a sequent calculus for complement-topos logic, which throws some light on the problem of giving a dualization for LJ.

A national survey of CEOs of manufacturing firms was conducted to identify factors explaining CEOs' intentions to engage in two questionable business practices: soliciting a competitor's technological secrets and making payments to foreign government officials to secure business. Drawing on research in corporate misconduct, ethical decision making, and strategic management, the authors analyzed ethical intentions by looking at hostile environmental conditions, opportunity-rich situations, and/or personal characteristics. Based on responses to scenarios, their findings suggest that the ethical intentions of CEOs may (...) be more affected by the decision maker's predisposition than by environmental pressures or organizational/situational characteristics. En torno al libro de Hannah Arendt Los orígenes del totalitarismo se buscan explicaciones a la lógica del Estado totalitario, es decir, su modo de operar y sus consecuencias en el ámbito de la libertad, del reconocimiento y del modo de vida que los sujetos pueden esperar en tal Estado. Se encuentra que el terror que se impone logra una deshumanización de los sujetos que, al haber perdido todo lo racional, se encuentran en el territorio de lo inconcebible.

El texto recoge y organiza las referencias al cuerpo, particularmente a manos y dedos, en obras kafkianas como los Diarios y Correspondencia, además de El Proceso, El Castillo, La colonia penitenciaria y otros relatos. De este modo, prepara el argumento que permite ensayar la interpretación de la gestualidad y movimiento de aquellas articulaciones en el ámbito jurídico. La mano y cada uno de sus cinco dedos es empleada por Kafka con intención hermenéutica literaria y también jurídica. Decolonial/anti-colonial Black, Indigenous and Mestiza feminist movements and scholar-activists foreground how the oft-touted apocalypse that the Covid-19 pandemic heralds is not new, nor does it signify the great rupture into chaos that those from within modernity-coloniality often claim it to be. Rather Covid-19 is preceded by and will be out-lived by the apocalyptic anti-life onto-epistemological logics that are foundational to the (re)production of hetero-patriarchal capitalist-(settler) coloniality. However, one would commit the violence of reproduction of the epistemological logics and (ir)rationalities constitutive (...) of the current system if the story ended there. We have survived (despite our losses) and our survival points to the urgent necessity and responsibility of (critical) social theory to listen to the story of the pandemic from a Black/Indigenous genealogy and to begin the sense-making of the Covid-19 pandemic, from prior to this particular virus, outside, against and beyond the politics of knowledge of critical social theory itself. Thus, I invite you to journey to an affirmative re-enfleshment of reason and theory-making in relation to and dialogue with Black, Indigenous, and subaltern Mestiza feminist movements in southwest Colombia and in southeast so-called Australia in the unceded lands of the Awabakal and the Worimi. I explore this through the metaphor, the materiality, the cosmology and the herstory of the mangrove swamps a knowing-being otherwise (in)visible to the dehumanising gave of Whiteness and bring to thought three stories of a politics of knowledge of/as the Black/racialised and feminised body/flesh. To do this is to suggest that the co-creation of pathways which are life affirming and life making beyond and out of the post-Covid 19 conjuncture involves an epistemological-political project which decolonises and feminises the containments of reason and knowing (non)being of coloniality/modernity. Organ shortage constitutes an unsolved problem for every country that offers transplantation as a therapeutic option. Besides the largely implemented donation model and the eventually implemented market model, a theorized automatic organ procurement model has raised a rich debate in the legal, medical and bioethical community, since it could show a higher potential to solve organ shortage. In this paper, we study the main arguments for and against this model. We show how, in the light of empirical data extracted from (...) countries with a universal health care system, its implementation could lead to a positive impact on organ procurement rates. Three factors are envisioned as fundamental in the comprehension and a possible regulation of the automatic organ procurement model: the lack of recognition of the conscientious objection, the preservation of the right to choose end of life conditions, and the need to avoid incentives for families or healthcare professionals. El artículo 270.2 del Código penal español hace responsables a los prestadores de servicios intermediarios cuando existe una facilitación activa y no neutral de un comportamiento infractor en las obras protegidas por copyright. Ello se ha traducido en un mecanismo incierto que fomenta la colaboración acrítica con los titulares del copyright sin ponderar de forma adecuada la creatividad social a través del uso transformativo de la obra. Este artículo propone un análisis de la autoría como signo distintivo con la finalidad (...) de corregir esta incertidumbre normativa mediante una interpretación restrictiva del derecho de uso exclusivo eliminando los usos derivados como fuente generadora de una obligación de actuar, y a la vez, reconociendo la necesidad de un mecanismo de contra-notificación que permita al supuesto infractor una defensa efectiva de sus intereses sin que ello implique la pérdida de la condición de actor neutral. The great Buddhist writer Santaraksita (725-88) was central to the Buddhist traditions spread into Tibet. He and his disciple Kamalasila were among the most influential thinkers in classical India. They debated ideas not only within the Buddhist tradition but also with exegetes of other Indian religions, and they both traveled and nurtured Buddhism in Tibet during its infancy there. Their views, however, have been notoriously hard to classify. The present volume examines Santaraksita's encyclopedic Tattvasamgraha and Kamalasila's detailed commentary on that (...) text in his Panjika, two works that have historically been presented together. The works cover all conceivable problems in Buddhist thought and portray Buddhism as a supremely rational faith. One hotly debated topic of their time was omniscience -- infinite, all-compassing knowledge -- whether it was possible and whether one could defensibly claim it as a quality of the Buddha. (shrink)

Jones (1991) has proposed an issue-contingent model of ethical decision making by individuals in organizations. The distinguishing feature of the issue was identified as its moral intensity, which determines the moral imperative in the situation. In this study, we adapted three scenarios from the literature in order to examine the issue-contingent model. Findings, based on a student sample, suggest that (1) the perceived and actual dimensions of moral intensity often differed; (2) perceived moral intensity variables, in the aggregate, significantly affected (...) an individual''s moral judgments; and (3) some dimensions of moral intensity (namely, perceived social consensus and perceived magnitude of consequences) mattered more than others. In Democracy without Shortcuts, Cristina Lafont identifies proceduralist or ‘deep pluralist’ conceptions of democracy alongside epistemic and lottocratic approaches as shortcuts that avoid the more challenging but, in her view, preferable path of engaging with and attempting to sway competing views, values and beliefs of fellow citizens. I argue that with the wholesale dismissal of proceduralist accounts of democracy Lafont herself takes two shortcuts: The first concerns the characterization of deep pluralism as unable to explain substantive disagreement after a decision (...) is settled, and the second undervalues proceduralism’s ability to evaluate and criticize the substance of the political decision-making process. While her critique is fitting for minimalist conceptions of proceduralism, a theory of normative proceduralism shares many objectives with Lafont’s vision of a participatory deliberative democracy. Integrating those approaches instead of dismissing proceduralism outright would render her project appealing to theorists who would not otherwise consider themselves deliberative democrats. (shrink)

Ausgangspunkt dieser Untersuchung sind Wittgensteins Analysen der Kippbilder, seine Reflexionen über das Sehen-als und die damit verbundene Spannung zwischen Identität und Differenz. Wittgenstein, so lautet die zentrale These des Buches, beschäftigte sich mit solchen außergewöhnlichen Phänomenen, weil sie die übersichtliche Darstellung der komplexen, symbolischen Praktiken menschlicher Lebensformen erlauben. Anhand unterschiedlicher Beispiele – physiognomischer Ausdruck, Witz, Kunst, Dichtung, sadomasochistische Perversion – erstellt Sara Fortuna eine Grammatik der Aspekte, die eng auf ethische Fragestellungen bezogen bleibt. Dadurch erscheinen Wittgensteins späte Gedanken als (...) Kritik einer philosophischen und kulturellen Tradition und es gelingt der Autorin, ihn mit Dante, Vico, Kant, der Psychoanalyse, der Anthropologie und der feministischen Philosophie in ein fruchtbares Gespräch zu bringen.
